Remote Online Notary

Remote online notarization (RON) allows you to get a document signed, verified, and sealed. The only difference is you can do it all without leaving the comfort of your home or office.

Typical Notary Procedure

While many factors may affect the process in which a notarization is conducted, they all follow a few basic procedures

The signer (or Power of Attorney) must personally appear before the Notary

The Notary must also assess whether the signer is fully aware and understands the document they are about to sign. If the signer’s mental capacity is hindered in some way, either by medication or some other means, the Notary is prohibited by law from continuing with the notarization.

This is to deter a signer from signing the document under duress or against their own free will.

The Notary must review the document(s) for completeness and determine the notarial act required

Confidentiality is paramount when conducting notary services

In most cases, we will have already discussed the associated fees prior to our appointment

Refer to the Texas Notary Fee Schedule section here for more information

There are three ways to identify a signer:

  1. Valid, unexpired government-issued identification containing both a photo and signature
  2. Personal Knowledge (to the Notary)
  3. Credible Witness

A photocopy or picture of an ID on the signer’s phone is not acceptable.

In Texas, the credible witness must be someone personally known to the signer AND must present #1 above.

The Notary must perform an oath or acknowledgment to the signer. Then, if the signer hasn’t done so already, they may now sign the document

Certain documents and notarial acts require the signer to sign the document in front of the Notary. Do not sign the document unless instructed, or notify the Notary that the document is already signed when scheduling the appointment

The Notary will now sign the certificate and affix their notary seal

Texas Law requires a Notary Public to maintain accurate records of every notarial act

The signer may review this information for accuracy and completeness and may sign that record in the Notary’s Journal

Texas Notary Public Laws

Notary Public laws vary from state to state, but a notarized document is valid across the country, regardless of notarization origin. In other words, a notarial act performed in one state is legally recognized in another state, as if the notary of the receiving state performed the notarial act. You must adhere to the notary legislation where the Notary Public is commissioned and located.

I am well versed in the Texas Government Code surrounding Notaries Public. You can read more about each statute here
